Constitution
JAMES H. RICHMOND COLLEGE
MURRAY STATE UNIVERSITY
Article I - Name
The name of this organization shall be James H. Richmond College. The Residential College Council shall be the elected body to help govern the College. The Residential College Council is a member of the Residential College Association. From here on, Residential College Council will be referred to as the RCC; the Residential College Association the RCA.
Article II - Purpose
The purpose of the RCC shall be to promote the following needs and rights of the members of James H. Richmond College:
1. adequate facilities,
2. health and safety of its members,
3. academic and athletic events,
4. participatory governance,
5. respect, tolerance and acceptance of diversity,
6. fair and judicious treatment.
Article III - Membership
Section A - Qualifications of Membership
To be eligible for membership of James H. Richmond College, one must
1. be an assigned member to this college and
2. be enrolled in classes at Murray State University; or
3. be voted on by the RCC as an honorary member.
Section B - Maintenance of Membership
To maintain membership in James H. Richmond College, one must promote a moral and ethical environment and be in good standing with Murray State University. Violations such as vandalism, use or possession of alcohol, controlled substances or weapons, sexual harassment, actions that put self or others at risk for harm (physical, mental, emotional, spiritual), and behaviors such as disrespect or intolerance of diversity will be taken to the College Head Council for action and is subject to University disciplinary action as stated in the Student Life Handbook.
ARTICLE IV - OFFICERS/REPRESENTATIVES
Section A - Residential College Council (RCC)
The RCC shall consist of the following elected officers:
· President
· Vice President - Administration
· Vice president - Programming
· Scribe
· Purser
· Sage
These officers shall be known as the Executive Committee.
The RCC shall consist of the following elected representatives:
· members at large (3)
· honor guards (5)
· representative from each floor (4)
· graduate student representative
· resident advisor representative
· commuter representative (4)
· RCA representative (2)
The College Head shall serve as advisor and ex-officio member to the RCC. The College senators to the Student Government Association (SGA) will also serve as ex-officio members. Representatives to the RCA will be the President of Richmond College and the two elected RCA representatives.
All members of the RCC shall maintain a GPA of at least 2.0. Inability to maintain this minimum will result in loss of office (See Article VIII Officer Replacement)
Section B - RCC Responsibilities
1. President
· presides over all meetings of the RCC,
· has prerogative to call executive or special meetings,
· rules on parliamentary procedure, questions or points,
· keeps the council informed of all new business,
· has power to form committees and appoint chairs,
· dismisses committees when business is finalized,
· is a non-voting member except in instances of a tie vote.
2. Vice President - Administration
· performs the president's duties in absence of president
· reports to the president
3. Vice President - Programming
· oversees all College programming and committees,
· performs the president’s duties in absence of president,
· reports to the President.
4. Scribe
· keeps precise and accurate records of all meetings
· handles all correspondence for the RCC
5. Purser
· keeps all financial records
· endorses all expenditures of the RCC
· assists the President and College Head in creating the budget
6. Sage
· documents all activities of James H. Richmond College
· maintains writings and photos in recording of the history of the College.
7. Members at Large
· represent the James H. Richmond College constituency,
· relate concerns from the members of the College,
· serve on select committees for university events (i.e. Homecoming, Convocation, Commencement)
8. Honor Guard
· are the caretakers of the colors and arms (coat of arms, banner and flag),
· present the colors and arms at select university events,
· raise colors at dawn; lower at dusk and, if possible, in the event of bad weather,
· attend meetings as determined by the President
9. Representative from Each Floor
· represents the members of the floor,
· relate concerns from the floor members to the RCC,
· serve on select committees for university events (i.e. Homecoming, Convocation, Commencement, etc.).
10. Graduate Student Representative
· represents the College graduate student constituency ,
· relate concerns from the graduate students to the RCC,
· serve on select committees for university events (i.e. Homecoming, Convocation, Commencement, etc.).
11. Resident Advisor Representative
· represents the Resident Advisors,
· relate concerns from the resident advisors to the RCC,
· serve on select committees for university events (i.e. Homecoming, Convocation, Commencement, etc.).
12. Commuter Representatives
· represent the College commuter constituency,
· relate concerns from the commuters to the RCC,
· serve on select committees for university events (i.e. Homecoming, Convocation, Commencement, etc.).
13. RCA Representatives
· together with the President, represent the concerns and best interests of the College and RCC to the RCA
· keep the College and the RCC apprised of RCA business
ARTICLE V - TENURE OF OFFICE
All officers and representatives shall hold their position for one academic year.
ARTICLE VI - OFFICER REPLACEMENT
In the case of the President leaving, the Vice Presidents shall share the duties of the Presidency while continuing with their present duties. In the case of one of the Vice Presidents leaving, the other Vice President and the President shall share the duties. In the case of any other officer or representative leaving, the RCC shall make an appointment to the vacancy for the remainder of the term.
ARTICLE VII - ELECTION OF OFFICERS/REPRESENTATIVES/SGA SENATORS
The process for elections for the RCC shall be in the spring semester between April 1 and May 1. The RCC will oversee all elections. The winner is declared by majority vote - 51% of those who voted. In elections by ballot, the voter must show his/her Racer ID and sign the log book.
ARTICLE VIII - VOTING ELIGIBILITY
All members of the James H. Richmond College, as defined by Article III, shall have voting power.
ARTICLE IX - IMPEACHMENT
The RCC shall go into executive session to consider impeachment charges against any RCC member. Charges of negligence against the accused shall be made by another council member and the accused shall have the right to refute the charges in the presence of the RCC body. Charges will be made and refuted no more than one week before a vote for impeachment can be made. Impeachment may be accomplished by a two-thirds majority vote of the RCC.
ARTICLE X - PROCEDURES
Section A - Agenda
The agenda for all RCC meetings shall reflect the following which is suggested by ROBERTS RULES OF ORDER:
1. President calls the meeting to order;
2. roll call of all officers and representatives;
3. officer reports;
4. committee reports
5. special reports
6. old business
7. new business
8. announcements
9. adjournment
Section B - Proposals
All proposals intended for presentation to the RCC from a member of James H. Richmond College shall be presented at one meeting and voted upon at the next regular meeting.
Section C - General Powers
The RCC shall have the power to legislate amendments, rules and regulations it deems necessary for the implementation of this Constitution and for the general welfare of the College members. Any legislation that falls under the direct authority of the Murray State University Housing Office shall be subject to approval by the Residential College Residence Director and the College Head.
The RCC shall have the power to go into executive session to discuss matters of personal nature that involve a member of the College.
ARTICLE XI - COMMITTEES
All committee meetings are open. All committees shall keep minutes and submit final reports at the end of the academic year. Minutes and final reports will be filed in the College Head office. The chair of each committee informs the Vice President of all programs and activities. The Vice President may choose to submit programs to the RCC for approval.
Section A - Social Programming Committee
The Social Programming Committee shall decide on programs for education and entertainment for all members of the College. Members of this committee shall select a chair who will also serve as liaison to the RCA.
Section B - Competitions Committee
The Competitions Committee shall consist of two sections: athletic competition and academic competition. The athletic competition subcommittee will select a chair who reports to and is guided by the College's Athletic Director. The academic competition subcommittee will select a chair and will be guided by a faculty advisor.
Section C - Other Committees
The President may form committees as needed.
ARTICLE XII - ADVISORS
The College Head shall serve as the College advisor. The Residence Director and the Resident Advisors shall serve as the College Residence advisors.
ARTICLE XIII - OUTSIDE INTERESTS
James H. Richmond College profits from its members. Therefore, any member including assigned faculty and staff may speak out at any regular meeting of the RCC. Twenty-four hour notice must be given in writing to the President before the member shall be allowed to speak and promote his/her ideas. Any matter affecting the College may be voted on at the next regular meeting.
ARTICLE XIV - RATIFICATION
Ratification of the James T. Richmond College Constitution shall take effect following a two-thirds majority vote of its members. The Constitution will remain in effect until a new Constitution or amendments and revisions are proposed and ratified.
ARTICLE XV - POLICIES
Section A - Alcohol, Controlled Substances and Smoking
No alcohol (beer, wine, liquor) or controlled substances are allowed in the College. Please refer to Article III, Maintenance of Membership.
Smoking is allowed only in resident rooms if agreed upon by the roommate. There is no smoking allowed in any other part of the College such as halls, study areas, recreation areas, offices, etc.
Section B - Weapons
According to Kentucky statute, concealed weapons are not allowed on state property or in state institutions such as schools and universities. Please refer to Article III, Maintenance of Membership.
Section C - Visitation
The visitation policy is created and voted on by the college members. Breech of rules/regulations, any threat to or intention to harm another person while in Richmond College will result in revocation of the visitation policy for the entire College.
Section D - Quiet Hours
Quiet hours shall be for a minimum of twelve (12) consecutive hours. Each floor of the Residence, as a sub-unit, may establish rules and regulations governing quiet hours, study times, and other appropriate matters other than visitation. Such rules and regulations will be established by majority vote of the residents of that floor, and must conform with College and University policy.
Section E - Environmental Pollution
Environmental pollution consists of those incidences that disrupt or debase the milieu of the College Residence and the space necessary for its Members to rest, work and evolve. Examples of environmental pollution include littering of any kind any place, vandalism, foul language, playing music too loud and shouting. There is to be no skate boarding or riding bicycles in the College Residence. Shopping carts are not allowed in the College Residence.
AMENDMENTS
1. The following elected positions will be added to the RCC:
a. Recycling Chair–Responsible for collecting and transporting of recyclable materials.
b. Decorating Chair–Responsible for organizing a committee for decorating. Oversees the creation and carrying out of the decorating responsibilities of the Richmond RCC.
c. Publicity Chair–Responsible for publicizing all Richmond RCC activities.
d. SGA Representative–Together with the President, represents the concerns and best interests of the College and RCC to the SGA. Keeps the College and the RCC apprised of SGA Business.
In the event that no one is elected to one or more of these positions, the RCC may appoint a person from the college to fill their position until the next election.
